1. Welcome
Welcome to Consul Money. These Terms of Service ("Terms") apply to the websites, mobile applications, software, features, content, and services provided by Consul Money ("Consul Money," "we," "us," or "our") under the Consul Money name (collectively, the "Service"). "You" means any person who accesses or uses the Service.
"Consul Money Parties" means Consul Money and our affiliates, officers, directors, employees, contractors, agents, representatives, licensors, suppliers, service providers, payment processors, app-store partners, successors, and assigns.
Our Privacy Policy explains how we collect, use, disclose, and protect information. By using the Service, you also agree to the Privacy Policy to the extent it applies to your use of the Service.
We may update these Terms from time to time. If we make material changes, we will use reasonable efforts to notify you, such as by email, in-app notice, or posting an updated version. Your continued use of the Service after updated Terms become effective means you accept the updated Terms.
If you do not agree to updated Terms, you may reject them by stopping your use of the Service and, if applicable, cancelling your subscription. If you access or use the Service after updated Terms take effect, you agree to the updated Terms.
2. The Service
Consul Money is a personal finance information management service designed to help you view, organize, budget, and understand your finances. The Service may include transaction tracking, account aggregation, budgeting, recurring payment tracking, investment and net worth views, alerts, reporting, subscription features, household sharing features, and related tools.
The Service is for your personal, household, and non-commercial use. You are responsible for obtaining the devices, internet access, wireless service, and other equipment needed to use the Service.
Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download, install, access, and use the Service for your personal use.
The Service may include beta, preview, experimental, early-access, automated, AI-assisted, machine-learning, or other evolving features. These features may be inaccurate, incomplete, unavailable, changed, limited, suspended, or discontinued at any time. Outputs from these features, including categorizations, forecasts, summaries, alerts, labels, suggestions, or insights, are informational only and must be independently reviewed by you before you rely on them.
Unless we expressly state otherwise in writing, Consul Money is not a bank, broker-dealer, investment adviser, investment broker, credit counselor, credit repair company, creditor, debt consolidator, debt adjuster, loan servicer, financial institution under the Gramm-Leach-Bliley Act, 15 U.S.C. 6801 et seq. ("GLBA"), consumer reporting agency under the Fair Credit Reporting Act, 15 U.S.C. 1681a(d) ("FCRA"), or furnisher of information to consumer reporting agencies. The Service is not a consumer report under the FCRA.
The Service and any content, categorizations, forecasts, notifications, or insights are provided for informational and organizational purposes only. They are not financial, investment, legal, accounting, tax, insurance, credit, or other professional advice, and nothing in the Service is an offer to sell, a solicitation to buy, or a recommendation for any security, insurance policy, financial product, purchase decision, or investment strategy.
Consul Money is not affiliated with any credit reporting agency and has no authority to determine your eligibility for credit, insurance, employment, government benefits, housing, check-cashing, deposit accounts, transaction accounts, or any other product, service, or transaction for which a consumer report may be used. We also do not take "adverse action" as defined under the FCRA. If applicable law prohibits your use of the Service, you are not authorized to use it, and we are not responsible for unlawful use.
3. Eligibility and Accounts
You must be at least 18 years old and able to form a binding contract to use the Service. You may not use the Service if we previously suspended or terminated your access unless we expressly authorize you to return.
The Children's Online Privacy Protection Act ("COPPA") requires certain online services to obtain parental consent before knowingly collecting personal information online from children under 13. Consul Money does not knowingly collect or solicit personal information from anyone under 18. If you are under 18, do not register for the Service or send personal information to us. If we learn that we collected personal information from a person under 18, we will delete it as soon as reasonably practical. If you believe a person under 18 provided information to us, please contact support@consul.money.
When you create an account, you agree to provide accurate, current, and complete information and to keep that information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account, including activity by anyone you invite or authorize to use or access your account.
You may not sell, transfer, assign, or share your account except through sharing features we make available within the Service. Notify us promptly at support@consul.money if you believe your account or credentials have been compromised.
4. Financial Data Authorization
The Service may allow you to connect accounts maintained by banks, brokerages, credit card issuers, payroll providers, merchants, financial institutions, or other third-party data sources ("Third-Party Data Sources"). We may work with third-party account aggregation, identity, payment, analytics, infrastructure, or financial technology providers to retrieve and process your account, balance, transaction, investment, holdings, identity, and related information ("Account Data").
When you connect a Third-Party Data Source, you represent that you have the right to provide the credentials, tokens, instructions, and authorizations needed to access that source. You authorize and direct Consul Money and our service providers to access the Third-Party Data Sources you select, retrieve Account Data, use that Account Data to provide the Service, and take related technical steps on your behalf.
For the limited purpose of obtaining and providing Account Data through the Service, you appoint Consul Money and our applicable service providers as your agent to access Third-Party Data Sources and retrieve Account Data as you could do personally. You understand that Consul Money and our service providers act at your request and with your authorization, not on behalf of any Third-Party Data Source.
Solely to obtain and provide Account Data to you through the Service, you grant Consul Money and our applicable service providers a limited power of attorney and appoint them as your attorney-in-fact and agent, with authority to access sites, servers, systems, documents, and information maintained by Third-Party Data Sources, retrieve Account Data, and use your information as necessary to perform those activities as you could do in person.
When Consul Money or our service providers access and retrieve information from Third-Party Data Sources, they do so at your request, with your permission and authorization, and not on behalf of the Third-Party Data Sources.
You agree that Third-Party Data Sources may rely on the authorization, agency, and limited power of attorney you grant in these Terms. You understand that the Service is not sponsored or endorsed by any Third-Party Data Source accessible through the Service.
We do not control Third-Party Data Sources and cannot guarantee that Account Data will be available, current, complete, or accurate. Account Data may be delayed, incomplete, miscategorized, duplicated, unavailable, or different from the official records maintained by the applicable Third-Party Data Source. You should consult the official account statements and records from your financial institutions before making decisions or transactions.
If you choose to connect Apple Card, Apple Cash, Savings, or other eligible Apple Wallet financial accounts through Apple FinanceKit, you authorize Consul Money to request your consent through Apple's system interface, read the balances, credit limits, account details, and transactions you approve sharing, and sync that Account Data to Consul Money so it can be displayed, categorized, analyzed, backed up, and used with Service features. Apple may allow you to choose which accounts and date ranges to share.
FinanceKit data is read from the on-device Apple Wallet data store only after your authorization. After you authorize sharing and Consul Money imports that data, Consul Money's use, storage, syncing, deletion, and disclosure of the imported data are governed by these Terms and our Privacy Policy. Apple is not responsible for Consul Money's handling of Account Data after you share it with us.
You may revoke our ongoing access to a Third-Party Data Source by disconnecting the account in the Service or by contacting us. Revocation may limit or disable features that depend on Account Data.
5. Household and Sharing Features
The Service may allow you to create or join a household, create or accept an account link, invite other users, share account information, share budgets or categories, authorize a financial professional or adviser, or otherwise grant access or permissions to other people. "Shared Users" means anyone you invite, authorize, link with, share with, or allow to access information through the Service, including household members, members of an account link, linked account users, financial professionals, advisers, and other authorized users.
If you create, accept, or participate in a household, account link, shared account, linked profile, or similar sharing relationship, Shared Users may be able to view, access, export, edit, categorize, sync, receive, or otherwise interact with your account information, personal information, Account Data, transactions, balances, budgets, categories, rules, recurring items, investments, reports, settings, or other information through the Service. This access may apply even if a privacy, visibility, category, account, profile, or similar setting would otherwise hide or limit that information outside of the household, account link, or sharing relationship.
You are responsible for the people you invite, link with, authorize, or grant permissions to, and for understanding what information may become available through each household, account link, or sharing feature. You represent that you have all rights and permissions needed to share any information you make available to Shared Users. You are responsible for all activity by Shared Users and any other person who uses your account or accesses the Service through your authorization. We are not responsible for disputes between you and Shared Users.
6. Communications
By using the Service, you consent to receive electronic communications from us about your account, security, privacy, billing, subscriptions, support, product updates, and administrative matters. These communications may be sent by email, in-app message, push notification, or posting within the Service, and satisfy any legal requirement that communications be in writing to the extent permitted by law.
You agree that you can store electronic communications from us so they remain accessible to you in an unchanged form. If we learn of a security incident that legally requires notice, we may attempt to notify you electronically by posting a notice in the Service or sending email to the address associated with your account. If you have a legal right to receive a written notice, or if you want to withdraw consent for electronic notices where withdrawal is legally available, contact support@consul.money.
When you register for or use the Service, we may send automatic and optional push notifications, alerts, emails, or similar messages based on your account settings and the notification preferences you select. Some notifications may be turned on by default. By using the Service, you agree to receive notifications about your use of the Service and Account Data. You may disable push notifications through your device or in-app settings, but some account, security, billing, or administrative messages may still be sent.
You may opt out of non-essential marketing communications by following the unsubscribe instructions in those messages or by emailing support@consul.money with "OPT-OUT," "UNSUBSCRIBE," "STOP," or "REMOVE" in the subject line. You may be unable to opt out of transactional or administrative communications that are necessary to provide the Service.
Notifications may contain financial or other sensitive information. We cannot control every factor affecting message delivery, and messages may be delayed, inaccurate, unavailable, or not delivered due to device settings, network issues, third-party systems, or other causes outside our control. We are not liable for transmission delays, notification failures, erroneous notification content, or actions taken or not taken in reliance on a notification.
7. Acceptable Use
You represent, warrant, and agree that you and your Shared Users will use the Service only for lawful purposes and in accordance with these Terms. You will not, and will not assist anyone else to:
- use, copy, install, transfer, distribute, sublicense, or make the Service available except as specifically allowed by these Terms;
- use the Service for commercial purposes, resale, or on behalf of a third party except as expressly permitted by us;
- violate any applicable law, regulation, contractual obligation, or third-party right;
- provide false, misleading, unauthorized, fraudulent, deceptive, infringing, defamatory, harassing, threatening, obscene, or otherwise objectionable information;
- submit User Content or otherwise interact with the Service in a way that infringes or violates intellectual property, privacy, publicity, contract, or other rights of anyone, including Consul Money;
- access or use any account, data, system, network, password, or security information without authorization, or attempt to obtain another user's password, account, credentials, or security information;
- probe, scan, or test the vulnerability of the Service or bypass authentication, security, rate limits, or access controls;
- access, tamper with, or use non-public areas of the Service, Consul Money's systems, our service providers' systems, or technical delivery systems used to provide the Service;
- reformat, mirror, frame, reproduce, or circumvent the navigation, structure, presentation, or user interface of the Service;
- state or imply that Consul Money endorses any statement you make without our prior written consent;
- violate the security of any computer network, crack passwords or encryption codes, or interfere with the proper operation of the Service;
- run a mailing list, listserv, auto-responder, spam process, unattended process, or other process that overloads, disrupts, or creates unreasonable load on the Service;
- copy, store, modify, adapt, translate, reverse assemble, reverse compile, reverse engineer, decompile, disassemble, create derivative works from, or attempt to derive source code, non-public APIs, models, model parameters, model weights, algorithms, training data, or other underlying components of the Service except to the extent applicable law prohibits this restriction;
- engage in model extraction, exfiltration, stealing attacks, or similar attempts to discover or reproduce underlying components of the Service;
- crawl, scrape, spider, harvest, index, data mine, access programmatically by macro or other automated means, or use automated tools to access the Service or any content except as authorized by us in writing;
- harvest or collect information about other users without their prior written consent;
- solicit personal information from other users except as permitted by the Service's functionality;
- restrict, discourage, or inhibit anyone from using the Service, or disclose personal information about another person without that person's consent;
- upload or transmit malware, harmful code, spam, deceptive content, or materials that interfere with the Service;
- harass, abuse, threaten, defame, impersonate, harm, advocate harm against, or incite harassment, abuse, or harm of another person or group, including Consul Money employees, contractors, support personnel, or users;
- use the Service for illegal, inappropriate, sexual, exploitative, abusive, or unauthorized contact with another person;
- remove or alter proprietary notices or misrepresent your relationship with Consul Money;
- use the Service, any Consul Money technology, or any Service output to build, train, benchmark, improve, or develop artificial intelligence, machine learning, financial technology, or other products or services, whether or not competitive with Consul Money;
- use the Service to build, train, benchmark, improve, or develop a competing product or service;
- create liability for Consul Money or cause Consul Money to lose the services of any supplier, licensor, provider, or partner; or
- attempt to interfere with, degrade, overload, or disrupt the Service or any systems used to provide it.
You further represent and warrant that you are providing information only about your own credit, accounts, assets, liabilities, transactions, income, financial life, and other information, or that you have all rights and authorizations necessary to provide any information submitted to Consul Money by you or by third-party providers you authorize through the Service.
We may investigate suspected violations and take technical, legal, or account action we deem appropriate, including suspension, termination, blocking access, and implementation of technical measures to prevent violations and enforce these Terms. A violation of the restrictions or representations in this section is grounds for termination of your right to use or access the Service.
8. User Content and Feedback
You may submit, upload, import, create, store, categorize, label, comment on, or otherwise provide information through the Service ("User Content"). As between you and Consul Money, you retain ownership of your User Content, subject to the licenses granted in these Terms.
You grant Consul Money and our designees a worldwide, non-exclusive, royalty-free, sublicensable, transferable, assignable license to host, store, reproduce, modify, adapt, format, translate, display, perform, distribute, create derivative works from, and otherwise use your User Content as reasonably necessary to operate, maintain, secure, support, analyze, improve, develop, and provide the Service. This license is subject to the Privacy Policy to the extent your User Content includes personal information.
If you store User Content in your personal account in a way that is not viewable by any other user except you ("Personal User Content"), you also grant Consul Money the right to display, perform, and distribute that Personal User Content solely to make it available to you and provide the Service.
If you share User Content only with specified users or a limited audience, such as Household Members, Shared Users, or other users you choose ("Limited Audience User Content"), you also grant Consul Money the right to display, perform, and distribute that Limited Audience User Content solely to make it available to the specified users and provide the Service. You also grant those specified users a license to access and use that Limited Audience User Content as permitted by Service functionality.
The licenses you grant are royalty-free, perpetual, sublicensable, irrevocable, and worldwide to the fullest extent permitted by law. When you delete your account, we will stop displaying your User Content to other users where applicable, except that content you made public or shared with others may remain available, and it may not be possible to completely delete User Content from backups, records, logs, archives, or copies stored by other users or third parties.
You represent that you have all rights needed to provide your User Content and grant these rights. You are responsible for your User Content and for ensuring it does not violate law, infringe rights, contain malware, or include confidential information you are not authorized to provide.
You are responsible for all User Content you contribute in any manner, and you will keep your registration information accurate and current. You are also responsible for all activity by you, your Shared Users, and anyone else who acts through your account or authorization.
To the extent permitted by law, you waive any moral rights or similar rights you may have in User Content as used by Consul Money under these Terms. We will not use your name in our advertising or marketing materials in connection with your User Content without your consent. User Content is not confidential unless we separately agree in writing.
We have the right, but not the obligation, to monitor the Service and User Content, remove or alter User Content, and disclose User Content and related circumstances to operate the Service, protect Consul Money and others, enforce these Terms, and comply with law, legal process, or governmental requests. We do not endorse and are not responsible for opinions, advice, information, links, or statements posted or made available by users or third parties through the Service.
By providing User Content, you represent, warrant, and covenant that you created or own it or otherwise have sufficient rights to provide it; it does not infringe, misappropriate, defame, libel, or violate any third-party right, including copyright, trademark, patent, trade secret, privacy, publicity, moral, or other proprietary rights; it does not contain viruses, adware, spyware, worms, or other harmful code; and it does not include confidential information of a third party unless you are authorized to provide it.
We reserve all rights and remedies against any user who breaches these User Content representations, warranties, or covenants.
If you provide ideas, suggestions, feedback, feature requests, or other recommendations, you grant Consul Money the right to use them without restriction or compensation to you.
Notwithstanding anything to the contrary, you acknowledge and agree that Consul Money, our suppliers, and our licensors may create aggregated, de-identified, or anonymized data from personal data collected through the Service, including by removing information that makes the data personally identifiable to a particular user ("Aggregated De-Identified Data"). Consul Money, our suppliers, and our licensors may use Aggregated De-Identified Data and disclose it to third parties for lawful business purposes, including to analyze, build, improve, and promote the Service and related businesses, products, and services, provided the data is not disclosed in a manner that identifies you.
9. Subscriptions and Payment
Some features may require a paid subscription, in-app purchase, or other paid plan. Prices, billing periods, renewal terms, trial terms, taxes, and included features will be presented at checkout or in the applicable app store, payment flow, or subscription management interface.
If you purchase an automatically renewing subscription, you authorize Consul Money, the applicable app store, payment processor, or subscription platform to charge your selected payment method on a recurring basis until you cancel. You must maintain accurate billing information and are responsible for all charges, taxes, fees, overdraft fees, and other amounts associated with your subscription or payment method.
If a subscription fee is not paid on time or a transaction cannot be processed, we may suspend, disable, cancel, or terminate your access to paid features or the Service, and you remain responsible for amounts due. To the extent provided by your payment network, issuer, app store, or payment processor, we or our processors may receive updated payment card information, such as a new card number or expiration date, and use it to help prevent interruption of the Service. You can update your payment method through account settings, the applicable app store, or the payment flow made available to you.
You agree to the pricing, payment, renewal, and billing policies in effect when a fee becomes payable. We do not provide price protection or refunds because of a price drop, discount, promotional offer, or change in plan availability. All fees are in U.S. dollars unless otherwise shown at checkout, and all fees are non-refundable except as expressly stated in these Terms, shown at checkout, required by the applicable app store, or required by law.
You must provide accurate and complete information for a valid payment method you are authorized to use, including a credit card, debit card, app-store payment method, or other payment method accepted by us. You authorize Consul Money, our payment processors, the applicable app store, and subscription platforms to charge that payment method for your subscription and any additional paid features or purchases made through your account. If we do not receive payment, you agree to pay amounts due on demand and to resolve disputes with your payment provider. We may retry declined payments or, where permitted, process charges in one or more installments for the selected subscription term. You are responsible for all use of your payment method and for any overdraft, insufficient funds, foreign exchange, carrier, tax, or other charges assessed by third parties.
If you purchased through Apple, Google, or another third-party app store, your subscription, cancellation, renewal, refund rights, taxes, currency conversion, and account management may be handled by that store and subject to that store's policies. Consul Money may not be able to initiate, manage, cancel, or refund app-store subscriptions directly. For Apple subscriptions, you can generally manage or turn off auto-renewal through your Apple account subscription settings.
When you cancel a subscription, you cancel future charges only. Unless otherwise stated at checkout or required by law, cancellation becomes effective at the end of the then-current billing period, and you will continue to have access to paid features through that period. To avoid future charges, you must cancel before the renewal deadline shown by the Service, the app store, or the subscription platform. If you purchased through a third party, you must cancel through that third party.
Except as otherwise stated at checkout, in an offer, or required by law, subscription fees are non-refundable and you are not entitled to a full or partial refund or credit after cancellation. We may issue refunds, credits, discounts, or other accommodations in our sole discretion, but doing so does not obligate us to provide the same or similar treatment in the future. If a limited refund period is expressly offered by Consul Money for a direct purchase, you must follow the stated refund process and timing for that offer. Refunds for third-party purchases are governed by the third party's policies.
Free trials, promotional pricing, referral rewards, discounts, coupons, or credits may be offered at our discretion. We may determine eligibility, modify, revoke, or discontinue offers, and prevent abuse of offers. If a trial automatically converts to a paid subscription, you must cancel before the trial ends to avoid charges. You may be limited to one free trial or discounted offer and may not combine promotions unless an offer expressly allows it. If your subscription is cancelled or terminated, you may not be eligible for another trial or discounted offer.
We may terminate your subscription in our discretion. If we cancel a paid subscription for reasons other than your violation of these Terms, we may provide a prorated refund for the unused paid period where appropriate or required by law. We are not obligated to provide a refund if we terminate your account or subscription because we determine that your conduct, account activity, or use of the Service violates these Terms, violates law, creates risk, or harms Consul Money, users, providers, or others. Upon termination or cancellation, you may lose access to paid features, content, data views, exports, reports, and work product associated with the Service.
We may change prices or plan features on a prospective basis. If a price increase applies to an automatically renewing subscription, we will provide notice as required by law or the applicable subscription platform. Your continued subscription after the change takes effect means you accept the new price or terms.
10. Third-Party Services
The Service may include links, connections, integrations, data, software, payment services, account aggregation providers, financial data providers, app stores, analytics tools, hosting providers, and other products or services provided by third parties ("Third-Party Services"). Third-Party Services are not owned or controlled by Consul Money and may have their own terms, privacy policies, fees, limitations, and availability.
When you access third-party websites or use Third-Party Services, you accept that there are risks in doing so. You should read the terms and privacy policies that apply to each Third-Party Service. You are responsible for reviewing and complying with those terms. We are not responsible for Third-Party Services, including their content, availability, accuracy, security, privacy practices, fees, actions, or opinions expressed by third parties.
Consul Money has no control over, and assumes no responsibility for, third-party websites or services. We do not monitor, verify, censor, or edit third-party websites or services. By using the Service, you release and hold Consul Money harmless from liability arising from your use of Third-Party Services. Inclusion or availability of a Third-Party Service does not mean we endorse it.
11. Security
We use reasonable administrative, technical, and organizational measures designed to protect the Service. However, no service, network, device, transmission, or storage system is completely secure. You are responsible for using a strong password, protecting your devices and credentials, keeping account recovery information current, and promptly reporting suspected unauthorized access.
12. Ownership
The Service, including software, design, interfaces, text, graphics, logos, icons, images, data structures, workflows, algorithms, compilations, updates, enhancements, modifications, originals, copies, and other content provided by Consul Money, is owned by Consul Money or its licensors and is protected by intellectual property and other laws. This proprietary information contains valuable copyrighted and proprietary material and is licensed to you, not sold. Except for the limited license expressly granted to you, you have no rights in the Service, and we and our licensors reserve all rights.
You and your Shared Users may not modify, publish, transmit, participate in the transfer or sale of, reproduce, create derivative works based on, or otherwise exploit any part of the Service except as expressly allowed by these Terms or by Service functionality.
You may not use Consul Money's names, logos, trademarks, service marks, design marks, trade dress, or branding without our prior written permission, including in a way that suggests affiliation, endorsement, sponsorship, or that is likely to cause confusion. You may not challenge Consul Money's ownership or validity of our marks to the extent permitted by law. All goodwill from your permitted use of our marks will inure to Consul Money. All third-party names and marks are the property of their respective owners.
13. Changes and Termination
We may modify, suspend, limit, discontinue, or remove any part of the Service at any time. We will try to provide notice of material changes that adversely affect paying users when practical, but we may act without notice when needed for security, legal compliance, maintenance, abuse prevention, business operations, or other reasons.
You are responsible for maintaining your own copies of information that matters to you, including official financial records, statements, tax records, budgets, exports, reports, and User Content. Consul Money is not your system of record and has no obligation to preserve, maintain, recover, or provide copies of any data except as expressly required by applicable law.
You may stop using the Service at any time and may delete your account through available account settings or by contacting support. Account deletion may result in loss of access to data, settings, content, subscriptions, or features. Some information may be retained as described in the Privacy Policy or as required by law, legitimate business needs, backups, security, fraud prevention, or dispute resolution.
We may suspend or terminate your access to the Service if we believe you violated these Terms, created risk or possible legal exposure, used the Service unlawfully, failed to pay amounts due, or otherwise harmed Consul Money, users, Third-Party Services, or the Service.
Sections that by their nature should survive termination will survive, including ownership, payment obligations, disclaimers, limitation of liability, indemnification, dispute resolution, and miscellaneous terms.
14. Disclaimers
To the fullest extent permitted by law, the Service and all content, Account Data, notifications, reports, forecasts, categorizations, calculations, and insights are provided "as is," "as available," and with all faults. You bear the risk as to quality, performance, accuracy, availability, and effort.
The Consul Money Parties disclaim all warranties and conditions, whether express, implied, statutory, or otherwise, including warranties or conditions of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, accuracy, completeness, timeliness, reliability, availability, informational content, and absence of viruses or damaging or disabling code.
You acknowledge that, because of the nature of the internet, mobile networks, devices, third-party systems, and telecommunications infrastructure, the Service may be unavailable when needed, and information transmitted through the Service may be interrupted, delayed, corrupted, intercepted, or modified by third parties. The Consul Money Parties are not responsible for losses, damages, or liabilities arising from telecommunications failures, internet failures, device failures, third-party service failures, or misuse of content or information accessed through the Service.
Neither Consul Money nor our licensors will be considered an "expert" under the Securities Act of 1933, and the Consul Money Parties do not warrant that the Service complies with requirements of the Financial Industry Regulatory Authority, the Securities and Exchange Commission, any securities exchange, any similar organization or regulator, or securities laws of any jurisdiction.
Neither Consul Money nor any entity whose information is made available through the Service is responsible for the accuracy, completeness, timeliness, sequence, usefulness, reliability, or content of prices, quotes, equity sales, market data, investment data, third-party data, or information derived from such data. You agree that the Consul Money Parties are not liable for losses arising from inaccuracies, defects, omissions, errors, delays, or interruptions in such data.
Consul Money is not responsible for the accuracy of Account Data obtained from Third-Party Data Sources and displayed or reported through the Service, and we do not represent or warrant that we can retrieve Account Data from any particular source, maintain any connection, or correct information supplied by a third party. If Account Data appears inaccurate or outdated, you should contact the applicable Third-Party Data Source.
The Service may include estimates, categorizations, projections, investment-related information, market data, budgets, recurring transaction predictions, or other informational content that may be incomplete, delayed, inaccurate, or unsuitable for your circumstances. Investment results cannot be guaranteed; all investments involve risk, including possible loss of principal, and may be affected by economic, political, market, and other factors. You are solely responsible for decisions you make based on the Service and should consult qualified professionals before making financial, investment, legal, accounting, tax, insurance, or other professional decisions.
Consul Money does not assume any fiduciary, advisory, monitoring, auditing, correction, recordkeeping, tax-preparation, reporting, or compliance obligation to you. Except for the limited agency described in Section 4 solely for retrieving Account Data at your request, nothing in the Service or these Terms creates an agency, fiduciary, trustee, adviser, or professional-client relationship.
The Service does not provide official account records and should not be used for transaction authorization, tax filing, regulatory reporting, credit eligibility, insurance eligibility, employment screening, lending decisions, tenant screening, or any purpose for which a consumer report may be used under the Fair Credit Reporting Act or similar laws. If you are dissatisfied with the Service, your sole and exclusive remedy is to stop using it.
15. Limitation of Liability
To the fullest extent permitted by law, the Consul Money Parties will not be liable for any indirect, incidental, special, consequential, exemplary, enhanced, or punitive damages; lost profits; lost revenue; loss of goodwill; loss of data; business interruption; device failure; or costs of substitute services, whether based on contract, tort, strict liability, statute, or any other theory, even if advised of the possibility of such damages.
To the fullest extent permitted by law, the total liability of the Consul Money Parties for all claims arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid to Consul Money for the Service during the 12 months before the event giving rise to the claim or (b) $100.
Each user is solely responsible for their use of the Service and for damages incurred by that user or any third party arising from or related to that use. You represent that you have independently evaluated the advisability and risks of using the Service and are not relying on the Consul Money Parties to insure against those risks.
Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the above limitations may not apply to you. In those jurisdictions, liability will be limited to the greatest extent permitted by law.
16. Indemnification
You agree to defend, indemnify, and hold harmless the Consul Money Parties from and against claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to:
- your access to or use of the Service;
- your User Content or Account Data you authorize us to access;
- your breach of these Terms or any representation, warranty, or covenant in these Terms;
- your use of the Service in a way not specifically authorized by these Terms or by Service functionality;
- your violation of these Terms or applicable law;
- your infringement or misappropriation of any third-party right;
- activity by Shared Users or others using your account; or
- your dispute with a Third-Party Data Source, Third-Party Service, Shared User, or other third party.
Your indemnification obligations include reasonable attorneys' fees, court costs, investigation costs, settlement amounts, judgments, and lost revenues to the fullest extent permitted by law. We may assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense. You may not settle any indemnified matter without our prior written consent.
17. Third-Party Disputes
Consul Money is not affiliated with your financial institutions, carriers, app stores, payment providers, merchants, employers, other users, Shared Users, household members, Third-Party Data Sources, or Third-Party Services. Any dispute you have with those parties is directly between you and that party.
You release Consul Money and our officers, directors, employees, contractors, agents, affiliates, successors, and assigns from claims, demands, and damages, actual and consequential, known and unknown, arising out of or related to those disputes.
If you are a California resident, you waive California Civil Code Section 1542, which provides that a general release does not extend to claims a creditor does not know or suspect to exist in the creditor's favor at the time of executing the release and that, if known, would have materially affected the creditor's settlement with the debtor.
18. Force Majeure
Any computer system, service, network, or device, whether yours, ours, a mobile carrier's, an internet service provider's, a cloud provider's, an app store's, or another provider's, may experience unanticipated outages, slowdowns, maintenance, security precautions, capacity limitations, high traffic, transmission problems, or other interruptions. Consul Money will not be liable for delay or failure to perform resulting from those events or other causes beyond our reasonable control, including strikes, labor disputes, blockade, war, terrorism, riots, natural disasters, epidemics, governmental action, power failures, internet or telecommunications failures, cloud provider outages, app-store actions, or failures of Third-Party Services.
19. Dispute Resolution
Informal resolution
Before filing a claim, you and Consul Money agree to try to resolve the dispute informally. The party raising the dispute must send written notice describing the dispute and the requested relief to the other party. You may send notice to support@consul.money. We will send notice to the email address associated with your account or another address we have for you. The parties will have 30 days after notice is received to attempt to resolve the dispute.
Arbitration agreement
Except for the exceptions below, you and Consul Money agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, not in court. You and Consul Money waive the right to a jury trial.
The arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, except as modified by these Terms. The arbitrator will have authority to resolve disputes about the interpretation, applicability, enforceability, or formation of this arbitration agreement, subject to the class waiver below.
Exceptions
Either party may bring an individual action in small claims court if it qualifies. Either party may seek temporary or preliminary injunctive relief in court to protect intellectual property, confidential information, security, or unauthorized access while arbitration proceeds. Government agency claims and rights that cannot be waived by law are not limited by this section.
Class action waiver
You and Consul Money may bring claims only in an individual capacity. Class actions, class arbitrations, private attorney general actions, and representative proceedings are not permitted to the fullest extent allowed by law. The arbitrator may not consolidate claims of multiple people unless all parties agree.
Opt out
You may opt out of this arbitration agreement by emailing support@consul.money within 30 days after you first accept these Terms. Your email must include your full name, the email address associated with your account, and a clear statement that you opt out of arbitration. Opting out will not affect any other part of these Terms.
Governing law and venue
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs the arbitration agreement. For disputes that may proceed in court, you and Consul Money consent to exclusive jurisdiction and venue in the state and federal courts located in New York County, New York, unless applicable law requires another forum.
20. App Store Terms
Apple App Store
If you download or purchase the Service through the Apple App Store, these Terms are between you and Consul Money, not Apple. Apple is not responsible for the Service or its content and has no obligation to provide maintenance or support for the Service. If the Service fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price for the app, if any; to the maximum extent permitted by law, Apple will have no other warranty obligation for the Service.
Consul Money, not Apple, is responsible for addressing claims relating to the Service, including product liability claims, legal or regulatory compliance claims, consumer protection claims, and intellectual property claims. You must comply with applicable third-party terms when using the Service. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as a third-party beneficiary.
Google Play and other stores
If you download or purchase the Service through Google Play or another app store, your use may also be subject to that store's terms and policies. The store may manage billing, renewals, cancellations, refunds, and subscription notices for purchases made through that store.
21. Export Controls
You represent that you are not located in a country or region subject to a U.S. government embargo or designated by the U.S. government as supporting terrorism, and that you are not listed on any U.S. government list of prohibited or restricted parties. You agree not to export, re-export, or use the Service in violation of U.S. export control and sanctions laws or other applicable trade restrictions.
22. California Notice
Under California Civil Code Section 1789.3, California users are entitled to the following consumer rights notice. You may contact Consul Money at support@consul.money for help, complaints, or more information about the Service. The charges for paid portions of the Service are shown before purchase and in the applicable subscription or app-store purchase flow.

23. Miscellaneous
These Terms, together with the Privacy Policy and any additional terms presented for a feature or purchase, are the entire agreement between you and Consul Money regarding the Service and supersede prior or contemporaneous agreements on that subject.
You are responsible for all taxes, duties, app-store charges, carrier charges, data charges, currency conversion charges, governmental assessments, and other third-party fees associated with your activity in connection with the Service, except to the extent Consul Money is required by law to collect or remit them.
If any provision is found invalid or unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer these Terms in connection with a merger, acquisition, reorganization, sale of assets, change of control, or by operation of law.
Nothing in these Terms creates a partnership, joint venture, agency, franchise, fiduciary, or employment relationship between you and Consul Money. Except for Apple and Consul Money's service providers as expressly described in these Terms, there are no third-party beneficiaries.
Headings are for convenience only. The words "including" and similar terms mean "including without limitation." If we provide a translated version of these Terms, the English version controls to the extent of any conflict.
